1. Who we are / Chúng tôi là ai

English: KyNguyenAI (KyNguyenAI.com) operates an AI Creative Suite and a Cloud AI Studio & Creator Platform. We provide AI tools (music, voice, video) and send transactional / product-update emails only to users who have given explicit consent.

2. How we collect email addresses / Cách thu thập email

English: We collect email addresses only through:

  • Explicit Opt-In via the subscription form on https://kynguyenai.com (checkbox not pre-checked);
  • Double Opt-In confirmation — a confirmation email must be clicked before status becomes “subscribed”;
  • Account registration on KyNguyenAI products where the user agrees to receive account/system notifications.

We never purchase, rent, scrape, harvest, or otherwise obtain email lists without permission.

3. What data we process / Dữ liệu xử lý

  • Name, email address, language preference;
  • IP address and user-agent at subscription time (abuse prevention);
  • Subscription status, confirmation / unsubscribe timestamps;
  • Delivery events: opens/clicks (if enabled), bounces, complaints;
  • Optional account fields such as credit/balance when provided by the user for personalization.

4. Purpose of processing / Mục đích

We process data to: send system notifications, security alerts, invoices, feature updates; maintain suppression lists (bounce/complaint/unsubscribe); improve deliverability; and comply with law (CAN-SPAM, GDPR, applicable Vietnamese data protection rules).

5. Legal bases (GDPR) / Cơ sở pháp lý

  • Consent (Art. 6(1)(a)) for marketing / optional product updates;
  • Contract / legitimate interest for transactional and security emails related to an account;
  • Legal obligation for retention of certain logs when required.

6. Sharing / Chia sẻ

We work with trusted email delivery and infrastructure providers as data processors to send messages and to automatically process real-time bounce and spam complaint webhooks so invalid or complaining addresses are suppressed immediately. We do not sell personal data. Processors act under applicable data processing terms and international email deliverability standards (CAN-SPAM Act and GDPR).

7. Your rights / Quyền của bạn

You may at any time:

Unsubscribed, bounced, and complained addresses are placed on a global suppression list and will not receive further marketing/notification campaigns.

8. Retention / Lưu trữ

Active subscriber data is kept while the subscription remains active. Suppression records are retained to prevent re-mailing. Delivery and webhook logs are retained as needed for deliverability and abuse prevention (typically up to 24 months unless longer retention is legally required).

9. Security / Bảo mật

We use HTTPS, access-controlled admin panels, hashed passwords, rate-limited login, and email authentication best practices (SPF, DKIM, DMARC).

10. Children / Trẻ em

Our services are not directed to children under 16. We do not knowingly collect their data.

11. Changes / Thay đổi

We may update this policy; the “Last updated” date will change. Material changes will be communicated via the website or email where appropriate.
